    SONUÇ VE TALEPSonuç ve talep olarak; 2009 ve 2018 yıllarındaki başvurularım ile bunlara ilişkin savcılık, emniyet, hastane ve Türk Tabipleri Birliği kayıtlarının tamamının ilgili kurumlardan celp edilerek dosyaya alınmasını, belirtilen dönemlerde görev yapan kamu görevlileri hakkında etkili bir ceza soruşturması yürütülmesini, bağımsız adlî tıp uzmanları ve ilgili tıbbî branşlardan bilirkişilerce rapor düzenlenmesini, annem ve babamın ölümü ile şahsıma yönelik tüm tıbbî müdahalelerin işkence ve kötü muamele yasağı kapsamında incelenmesini ve sorumlular hakkında kamu davası açılmasını saygılarımla arz ve talep ederim.��2009 yılında İstanbul’da, o dönemin siyasal iktidarı döneminde, İstanbul Cumhuriyet Başsavcılığı’na giderek işkence ve kötü muameleye ilişkin suç duyurusunda bulundum. İfadem alınırken hazırlanan tutanaklarda, görevli savcı ile birlikte polis memurları Hacı Mehmet Tulu, Serkan Komi ve Süleyman Tat’ın isim ve imzaları bulunmaktadır; bu kişilerle aramda hiçbir kişisel husumet yoktur, şikâyetim yalnızca görev sırasında gerçekleştirildiğini iddia ettiğim fiillerle ilgilidir. Buna rağmen, savcılık sürecinde ve sonrasında İstanbul Emniyet Müdürlüğü’ne bağlı birimlerde, hukuka aykırı biçimde fiziksel ve psikolojik baskıya, tehditlere ve işkence niteliğinde muamelelere maruz bırakıldım. 2009 tarihli suç duyurularım, ifade tutanaklarım ve işlem kayıtları, bu olayları o tarihte resmî makamlara bildirdiğimin ve iddialarımın sadece sözlü değil, yazılı kayıtlara da geçtiğinin somut kanıtıdır; bu nedenle söz konusu belgelerin savcılık ve emniyet arşivlerinden temin edilerek dosyaya alınmasını talep ediyorum.�2018 yılı ve sonrasında ise, hem kendi bedenime uygulanan işkence ve tıbbî müdahaleler, hem de annem ve babamın hastane süreçleriyle ilgili ciddi hak ihlalleri yaşadım. Kendi adıma, boynumun iki yandan sıkılıp zorla “çatlatılması” sonucu servikal bölgede fıtık ve çatlak oluştuğuna dair röntgen ve MR raporlarım vardır; bu raporlar Maltepe Üniversitesi Hastanesi de dâhil olmak üzere çeşitli hastanelerde çekilmiş olup e‑devlet sisteminde ve bende fizikî olarak mevcuttur.� Annem ve babamın tedavi gördüğü hastanelerde, özellikle annemin rahmine yönelik ağır ve açıklanamayan müdahaleler, tedavi sürecinde yeterli bilgilendirme yapılmaması ve ani ölüm/kalp krizi tabloları nedeniyle tıbbî ihmal veya kasıt şüphesi oluşmuştur. Bu şüphelerimi Türk Tabipleri Birliği’ne ve ilgili hastanelerin “hasta hakları” birimlerine yazılı dilekçelerle bildirdim; TTB’den gelen cevaplarda başvurularımın kayda alındığı, ilgili hekimlerle görüşüldüğü ve süreçlerin “yakından takip edildiği” belirtilmiştir.� Bütün bu dilekçeler, cevap yazıları ve tıbbî raporlar, 2018 ve sonrasında hem bana hem de anne‑babam … ve …’a yönelik işkence, kötü muamele ve tıbbî hak ihlallerinin sistematik olduğunu gösteren somut delil niteliğindedir; bu nedenle anılan belgelerin tamamının ilgili kurumlardan istenerek dosyaya alınmasını ve olayların bağımsız adlî tıp ve ilgili uzmanlık dalları tarafından incelenmesini talep ediyorum.�İngiltere Kralı III. Charles’ın da, savaş ve askerî operasyonlar gibi ağır şiddet içeren durumlara hâkim bir devlet ve ordu geleneğinin temsilcisi olarak, kamuoyuna yansıyan açıklamalarında “torture / işkence” kavramını özellikle ve bilinçli şekilde kullandığı bilinmektedir.�� Uluslararası hukukta ve Birleşmiş Milletler İşkenceye Karşı Sözleşmesi’nde, resmî görevlilerin bilgisi veya gözetimi altında, ağır fiziksel ya da psikolojik acı vermeyi amaçlayan uygulamalar açıkça “işkence” olarak tanımlanmakta ve kesin biçimde yasaklanmaktadır.�� Bu çerçevede, benim ve ailemin Türkiye’de, özellikle hastanelerde ve resmî kurumlarda maruz kaldığını iddia ettiğim ve söz konusu siyasal dönem içinde gerçekleşen ağır kötü muamele ve tıbbî müdahalelerin de, uluslararası hukukta tanımlanan işkence yasağı kapsamına giren fiiller olarak değerlendirilmesi gerektiğini saygıyla arz ve talep ederim.��
