LEGAL AND TECHNICAL GROUNDS

  1. Aggravated Data Theft and Unauthorized Data Scraping via Social Media and Messaging Platforms: My personal identifying information, biometric/visual data, audio recordings, intellectual/creative works, and usage patterns across my Facebook profiles/pages, Instagram accounts, Telegram correspondence/channel records, TikTok, and LinkedIn accounts are being systematically extracted, scraped, duplicated, and exfiltrated to central third-party databases via automated bots, API exploits, and scraping tools without my knowledge or consent. The unlawful acquisition, retention, and processing of these private and proprietary assets constitutes direct statutory violations under Articles 135 (Unlawful Recording of Personal Data), 136 (Unlawful Acquisition or Dissemination of Personal Data), and 142/2-e (Aggravated Theft via Information Systems) of the Turkish Penal Code No. 5237.
  2. Breach of Confidentiality of Communications and Unlawful Interception of Private Channels: The surveillance, packet interception (including Deep Packet Inspection), content analytics, and eavesdropping executed against my electronic communications conducted across Telegram and the direct messaging (DM) functions of social media platforms directly violate Article 132 (Violation of Confidentiality of Communication) and Article 134 (Violation of Privacy of Personal Life) of the Turkish Penal Code. Unlawful Processing and Profiling of Social Media Data by Capital Market Brokerage Firms: Investment institutions, brokerage houses, and financial analytics entities are deploying behavioural financial models, algorithmic steering, and targeted manipulative content directed at me using data illicitly extracted from platforms including Facebook, Instagram, and Telegram. Under the Capital Markets Law No. 6362, the Personal Data Protection Law No. 6698 (KVKK), and Law No. 6563 on the Regulation of Electronic Commerce, carrying out financial steering, investment profiling, or targeted algorithmic pressure using social media data obtained without explicit informational disclosure and express consent constitutes an actionable regulatory and statutory violation.
  4. Information Security Violations and Strict Prohibition of Evidence Tampering: Unauthorized intrusions into my end-user devices via social media SDKs, tracking pixels, and telemetry agents constitute cyber offenses under Articles 243 and 244 of the Turkish Penal Code. Meta Platforms Inc., Telegram FZ-LLC, internet service providers, cloud hosts, and involved brokerage firms are legally obligated under Law No. 5651 and relevant cyber regulations to preserve all forensic server logs, API request histories, IP connection records, and database query trails in an unaltered, timestamped state. Any destruction, redaction, or alteration of this evidence will result in immediate criminal filings under Article 281 (Destruction, Concealment, or Alteration of Evidence) of the Turkish Penal Code against corporate executives and technical operators alike.

DEMANDS AND FORMAL LEGAL NOTICE

On the factual, technical, and legal grounds set forth above;

  3. I demand the formal, written certification specifying exactly which categories of my social media data were collected, the exact timestamps of collection, the source IPs/servers used, and the third parties to whom this data was transferred,
  4. I demand that the full identity records, corporate affiliations, IP allocations, and transaction logs of all natural persons, brokerage entities, data brokers, and technical intermediaries involved in these actions be placed on legal hold for submission to judicial authorities.

Otherwise, I hereby formally provide notice that administrative fines up to the statutory maximum will be pursued before the Personal Data Protection Board (KVKK), the Capital Markets Board (SPK), and the Information and Communication Technologies Authority (BTK); criminal prosecutions will be initiated through the Chief Public Prosecutor’s Offices pursuant to the relevant cybercrime, privacy, and theft provisions of the Turkish Penal Code; and comprehensive civil litigation will be commenced before all competent national and international courts to recover all accrued and prospective material and non-material damages.
