OPINION | The Münevver Karabulut Case: Was a Murder Orchestrated Over Sperm? Were Two Lovers Killed by Turning People Against Each Other?

9Author: Fehim Calgav – Dinamo Türk News
Type: Opinion piece / allegation and hypothesis. This text contains the author’s personal allegation. Dinamo Türk News is not a forensic medicine institution or a judicial authority; the points raised here are not proven facts, but questions submitted to the public and the competent authorities for their assessment.

Introduction
On 3 March 2009, 17-year-old Münevver Karabulut lost her life. Cem Garipoğlu was sentenced to 24 years in prison for this murder and died in prison in 2014. Years have passed, yet the darkest point of the case remains unresolved: the sperm traces found on Münevver’s underwear.

The official account
According to the Forensic Medicine Institute (Adli Tıp Kurumu) report, Münevver was a virgin and no sperm was found inside her body. Traces of blood and sperm were detected on her underwear and shorts. Subsequent DNA analyses announced that these traces did not match the Garipoğlu family, that they belonged to another person autopsied on the same day, and that they had been transferred because the autopsy technician used the same gloves in both autopsies. The Bakırköy 14th Criminal Court of First Instance sentenced the technician to 5 months in prison for “neglect of duty,” with the pronouncement of the judgment deferred; the two doctors were acquitted. The Istanbul 4th Administrative Court also ordered the Ministry of Justice to pay the family non-pecuniary damages.

My allegation
I object to this official account. In my view, the real cause and the centre of this murder is the sperm issue. My allegation is as follows: the possibility that the sperm found on Münevver Karabulut belonged to Cem Garipoğlu must be seriously investigated. I also believe that the later explanation, “it was transferred from another body,” may have steered the case away from the real question.

My thesis rests on this foundation: Münevver was a virgin; this is established by the reports. Had there been an ordinary, protected relationship between the two young people, no sperm trace would have been found either on her body or on her clothing. There would have been no biological finding to argue over, no dispute of “it belongs to this one, it belongs to that one.” In my opinion, in that case neither would this murder have been committed nor would such a scenario have been constructed. All the sperm-related disputes, lawsuits, penalties and compensation awards in this case revolve around this single point. To me, the very fact that so many lawsuits were filed strengthens my thesis: the sperm issue is not a detail of this case, it is its central knot.

Were the two young people turned against each other?
As the author, I believe that in this case two lovers, two 17-year-old young people, were turned against each other by people around them and became trapped inside a larger scenario. In my view, these two young people were in fact innocent, and both of them lost their lives at the end of this process. This opinion does not overturn the final conviction of Cem Garipoğlu. However, I am of the opinion that closing the case merely as a “crime of passion” is not sufficient.

Questions awaiting answers

  1. Were the sperm traces on the underwear compared directly with Cem Garipoğlu’s DNA profile in an independent laboratory? Why were the raw data and locus tables of this comparison not shared with the public?
  2. How were the sperm traces, described in the first report as “belonging to two different persons,” later attributed to a single other body? With which documents was the transition between the two reports explained?
  3. Was the contamination chain, meaning which table, which glove, what time and in what order, documented with photographs, records and official reports?
  4. Were the samples of the second person they were said to match and the traces on Münevver’s underwear examined by the same team on the same day? How did this rule out the possibility of a second contamination?
  5. Are the samples still preserved? If so, why is a re-test with today’s technology under the supervision of independent experts not permitted?
  6. The court tried only one technician, and only for “neglect.” Was the accuracy of the report’s content separately examined by an independent panel of experts?
  7. In the days before the murder, who interfered in the relationship between the two young people, and by what means? Was this circle examined in detail during the investigation?

Conclusion
I am not a forensic medicine institution; I ask questions as a publisher and as a citizen. The current official DNA results and court rulings state that the traces belonged not to Cem Garipoğlu but to another person. My allegation has not proven otherwise; it only demands that this conclusion be confirmed through an independent re-examination. This case changed autopsy rules in Turkey; after this incident, recording autopsies on camera and performing them one at a time became mandatory. If errors of this magnitude could be made at that time, looking again today at the reports from the same period is also a right.

Münevver Karabulut and her family deserve clear and documented answers to these questions.
