TO:The Office of the United Nations High Commissioner for Human Rights (OHCHR) – Special Rapporteur on the promotion and protection of the right to freedom of opinion and expressionCouncil of Europe – Commissioner for Human Rights & Safety of Journalists PlatformOSCE Representative on Freedom of the MediaDATE: 25 September 2026APPLICANT / DECLARANT: Fehim ÇalgavT.C. IDENTITY NUMBER: 556 360 729 14ORGANIZATION / PLATFORM: Dinamo Türk News Agency (https://dinamoturknews.com/)ADDRESS: Station Zero (Sakızağacı Sokak No:11, Red Sandstone House, Maltepe / Istanbul – TURKEY)CONTACT: +90 532 220 20 02 | Red.lion.king.fehim.calgav@gmail.com | Fehimcalgav@hotmail.comSUBJECT OF STATEMENT: Urgent Complaint and Notification Regarding the Arbitrary Blanket Blocking of Digital Archiving Infrastructures (archive.ph / archive.today) and Systematic Suppression of Investigative Public Records in Turkey (Violation of Article 19 ICCPR & Article 10 ECHR).FACTUAL RECORD & LEGAL GROUNDS1. Identification of the Administrative Violation:On 25 September 2026, technical and operational verification confirmed that the globally recognized web preservation and forensic archiving platform archive.ph (operating alongside archive.today and its network mirrors) was subjected to a nationwide administrative access blockade executed by the Information and Communication Technologies Authority (BTK) of the Republic of Turkey. The sanction was enacted via administrative fiat without public disclosure of judicial necessity or proportional review, enforcing total blacklisting across all Turkish Internet Service Providers.2. Direct Interference with Journalistic Archiving and Evidence Preservation:Digital repositories such as archive.today and web.archive.org serve as essential forensic infrastructure for independent journalists, investigative platforms, and human rights monitors. In Turkey, public-interest investigative reporting—specifically dossiers examining state officials’ credentials, constitutional eligibility requirements, public procurement irregularities, and systemic judicial overreach—is systematically suppressed via Sulh Ceza Hâkimlikleri (Peace Criminal Judgeships) and Law No. 5651 takedown mechanisms. By blacklisting archive.ph, administrative authorities are deliberately suppressing the primary instrument that timestamps, preserves, and protects judicial, constitutional, and journalistic records against retroactive digital erasure.3. Breach of International Human Rights Instruments:Article 19 of the ICCPR & General Comment No. 34: The UN Human Rights Committee explicitly affirms that generic bans on the operation of whole websites and network systems (including digital archiving platforms) are fundamentally incompatible with paragraph 3. The state has failed to substantiate that the blanket blocking of an entire digital archive satisfies the strict necessity and proportionality criteria required for any legitimate aim.Article 10 of the ECHR & Ahmet Yıldırım v. Turkey (App. No. 3111/10): The European Court of Human Rights established that blanket collateral blocking orders targeting entire digital platforms, hosting architectures, or technical repositories constitute a direct, unjustified violation of the right to receive and impart information.4. Requests for International Relief and Action:In my capacity as an independent investigative journalist and publisher of Dinamo Türk News:I formally request that the UN Special Rapporteur and Council of Europe monitoring bodies register this submission as an Urgent Communication / Media Freedom Violation Alert concerning Turkish administrative authorities.I urge an official inquiry requiring the Turkish Information and Communication Technologies Authority (BTK) to immediately lift the administrative blockage imposed on archive.ph and related archiving protocols.I append the forensic screenshots, network error logs, and verification records of the blocking notice as permanent exhibits.I declare that the information I have given is correct and complete.I accept all legal and administrative responsibilities arising from this statement.Date: 25 September 2026Name-Surname: Fehim ÇalgavSignature: Fehim ÇalgavEditorial Director, Dinamo Türk News
