IMPORTANT PUBLIC NOTICE REGARDING NEIGHBORHOOD RIGHTS AND ZONING LAWS!​Lately, we have observed an increase in zoning violations and “intrusive” surveillance that shatter the privacy of our homes and gardens. It is time to remind everyone of the legal regulations under Turkish Zoning Law (No. 3194) and the Turkish Penal Code:​1️⃣ The “Rear Yard” Setback is a Legal Requirement!​According to the law, buildings backing onto another parcel must maintain a minimum setback of 3 meters from the rear boundary. When two buildings back onto each other, there must be a total gap of at least 6 meters. Any balcony, terrace extension, or construction built within this 3-meter “protection zone” is ILLEGAL and subject to demolition.​2️⃣ Windows Cannot Be Opened on the Boundary Line!​In an “Attached Layout” (Bitişik Nizam), or when a wall is built directly on the property line, it must be a “Blind Wall” (Kör Duvar). This means:​NO windows, NO doors, and NO ventilation openings are allowed to face the neighbor’s property directly from the boundary.​Piercing a neighbor’s privacy by opening unauthorized windows is a direct violation of the zoning permit.​3️⃣ Intrusive Surveillance is a Crime!​While security cameras are for protection, pointing them directly at a neighbor’s garden, balcony, or windows is considered “Harassment” and a violation of the Turkish Penal Code (Article 134 – Violation of Privacy).​No one has the right to monitor your private living space under the guise of “security.” This is a criminal offense punishable by law.​4️⃣ Illegal Balconies and Terrace Extensions​Adding unauthorized balconies or enclosing terraces to oversee a neighbor’s backyard is not a “right of ownership.” These structures violate the original building project and are subject to heavy fines and “Seal and Demolition” orders by the Municipality.​⚠️ BOTTOM LINE:Property ownership does not give anyone the right to steal a neighbor’s sunlight, occupy their air space with balconies, or monitor their private garden.
